The online shop of the site wusaki.com is managed by L&W, which is the sole operator of this site. Any order placed with the shop through the website wusaki.com presupposes the prior reading and acceptance of these general terms and conditions.
Consequently, the consumer, referred to as the Customer, acknowledges being fully informed that their agreement to the content of these general terms and conditions of sale does not require a handwritten signature of this document, insofar as the Customer wishes to order online the products presented in the shop wusaki.com. The Customer may save or print these general terms and conditions of sale, it being specified that the retention of this document is their sole responsibility.
Prior to placing their order, the Customer declares that the purchase of these products has no direct connection with their professional activity, their purchase being reserved for their personal use. As a consumer, the Customer therefore has specific rights, which would be called into question if the products acquired on the site wusaki.com were in fact connected with their professional activity.
Our online shop, managed by L&W through the website wusaki.com sets out the following information:

- Indication of the price of the goods and, where applicable, the delivery charges, in euros
- Indication of the payment and delivery terms
- The existence of a right of withdrawal or of return of goods (subject to conditions)

All of this information is presented in French. The consumer declares that they understand this language and have full legal capacity to enter into commitments under these general terms and conditions.
Article 1: Entire Agreement
These general terms and conditions set out all of the obligations of the parties. In this respect, the Customer accepts without reservation all of the provisions set out in these general terms and conditions of sale. No other general or specific conditions may be incorporated into these terms, where such documents would be incompatible with these general terms and conditions of sale.
Article 2: Purpose
The purpose of these general terms and conditions of sale is to define the rights and obligations of each party in connection with the online sale of goods offered by L&W to its customers.
Article 3: Entry into Force and Duration
These general terms and conditions of sale come into force on the date of the order form. These general terms and conditions are concluded for the period necessary for the supply of the goods purchased, until the expiry of the guarantees owed by L&W.
Article 4: Electronic Validation
The Customer's "click" on the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
Article 5: Order Confirmation
The contractual information will be confirmed by e-mail at the latest at the time of delivery or, failing that, at the address indicated by the consumer on their order form.
Article 5.1: Weapons
For any purchase of a bladed weapon (knife, dagger, sword, axe, etc.), the Customer certifies that they are of legal age when submitting the order. L&W cannot be held responsible in the case of a purchase made for a third party.
Article 6: Proof of the Transaction
The computerised records, kept on the servers of L&W's hosting provider under reasonable security conditions, will be considered as proof of the communications, orders and payments between the parties. Order forms and invoices are archived on a reliable, durable and secure medium that can be produced as evidence if necessary.
Article 7: Product Information
L&W presents on its site wusaki.com the products for sale with the necessary characteristics to comply with article L 111-1 of the Code de la consommation (French Consumer Code), which provides that the prospective consumer may know, before placing a final order, the essential characteristics of the product they wish to acquire.
Article 8: Stock
The offers presented by L&W are valid only while stocks last.
Article 9: Applicable Prices
Prices are shown in euros and are valid only on the date on which the Customer sends the order form. They do not include shipping costs, which are invoiced in addition but are clearly visible from the start of the purchasing process. Prices are inclusive of all taxes, including the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products on the site wusaki.com. The full price of the items must be paid when ordering. At no time may the sums paid be considered as, or converted into, arrhes (a deposit that may be forfeited) or acomptes (a part-payment).
Article 10: Promotional Codes
The site Wusaki.com may provide its users with promotional codes that may be used once or several times depending on the case, within a specified period or while stocks last if a free product is concerned.
Wusaki.com reserves the right to interrupt or modify a discount code at any time and without notice if it is shared publicly. Any code or codes shared fraudulently may be modified or deactivated, as may all orders associated with such code or codes, without notice.
Article 11: Method of Payment
To pay for their order, the Customer may choose from all the methods of payment mentioned at the bottom of the order form. The Customer certifies that they hold the necessary authorisations to use the method of payment when validating the order form with L&W.
L&W reserves the right to suspend any order and any delivery in the event of refusal of payment authorisation by the officially accredited bodies or in the event of payment being refused by its bank.
L&W reserves the right, in particular, to refuse to make a delivery or to fulfil an order from a Customer who has not paid in full or in part for a previous order, for as long as that payment dispute exists.
For any order exceeding 500 euros and/or placed from abroad and/or with a foreign card, L&W's administrative department reserves the right to carry out an identity check, in order to ensure that no one is using another person's payment details without their knowledge. In the event of suspected fraud, L&W reserves the right not to ship the order.
Methods of payment vary according to the Customer's country and the destination of the parcel. In France, you can pay for your purchases by bank card (Visa, Mastercard, CB, American Express), by bank transfer or in 3 instalments with Scalapay.
Article 12: Shipping Times and Product Availability.
The order will be shipped at the latest within 3 to 4 working days from the day following the day on which the consumer placed and paid for their order. (See also the company information at the bottom of the page: shipping and returns). If the product ordered is unavailable, the Customer will be informed as soon as possible within 5 working days and will have the option of cancelling their order in part or in full. The Customer will then have the choice of being refunded the sum paid within 14 days at the latest, at their request, or of replacing the missing product with another product of the same or lower value. Sums will be refunded solely by the method of payment originally used by the Customer. L&W gives the Customer the option of receiving a credit note for the amount for later use.
Article 13: Delivery Terms
Products are delivered to the address indicated by the consumer on the order form in Metropolitan France and in countries belonging to the EU. Delivery means "the transfer to the consumer of physical possession or control of the goods" Art. L. 138-1 Loi n°2014-344 (French Law No. 2014-344).
Delivery without signature: the carrier's proof is authoritative
The consumer is responsible for their choice of delivery and acknowledges that delivery without signature - by its nature - transfers responsibility for the parcel from the carrier to the consumer from the moment it is placed in the letterbox or handed to a third party at the delivery address. Only the carrier's proof is authoritative. In the event of a dispute, the consumer must then turn directly to the carrier.
This responsibility may be transferred upon delivery against signature, which assures the consumer of proper delivery. To this end, the consumer must opt for Colissimo delivery against signature when placing the order.
Accuracy of the delivery address
The consumer is responsible for the delivery address they provide. They must provide as much information as possible for the proper routing of the parcel. If the parcel could not continue on its way due to an incomplete or incorrect address, the actual delivery costs of reshipment shall be borne by the consumer. These costs must be paid using the method of payment used for the initial order, before the parcel is reshipped.
Receipt on delivery
The consumer must check the condition of the parcel on receipt. If the parcel is damaged or abnormally light, they must open the parcel in front of the delivery person to check the condition of the products. The parcel must be refused if the consumer finds a product missing or damaged. Damage or missing products attributable to the carrier must be reported on the delivery note (in the case of delivery against signature), as well as to L&W, within 5 working days.
Delivery without signature
For a shipment without signature in Metropolitan France, the shipment may be made by Lettre Max or by Colissimo without signature, depending on the nature and size of the goods to be shipped.
Delivery by La Poste
If you are absent at the time of home delivery, a delivery notice will be left in the letterbox, allowing the parcel to be collected from the indicated post office during opening hours, within 15 days.
In the event of a delay in delivery compared with the date indicated in the shipping e-mail, the consumer must report this delay by contacting L&W's Customer Service, which will open an investigation with La Poste.
The investigation may take up to 30 days from the date on which the investigation begins. If the product is found during this period, it will be forwarded immediately. If, on the other hand, the product is not found at the end of the 30-day investigation period, La Poste considers the parcel lost and L&W will resend the goods at its own expense.
If the product or products ordered are no longer available at that time, L&W will refund the amount of the products affected by the carrier's loss.
L&W accepts no liability for extended delivery times caused by the carrier, in particular in the event of loss of the products or strikes.
Parcels returned to sender
Situation 1 : The carrier returns the parcel to L&W and the Customer is not responsible. For example, the shipping label was damaged during transport, preventing delivery of the parcel; the carrier attempted to deliver to an absent Customer and returned the parcel directly to L&W without even leaving it at the post office; the carrier returned the parcel because the pickup point chosen by the Customer was closed, without attempting to deliver the parcel to an alternative pickup point.
Upon receipt of the returned parcel, L&W undertakes to contact the Customer to offer to resend the parcel at no additional cost.
Situation 2 : The carrier returns the parcel to L&W and the Customer is responsible. For example, the Customer provided L&W with an incorrect or incomplete address; the Customer's name is not marked on the letterbox at the address indicated; the Customer did not collect their parcel from the pickup point within the holding period.
Upon receipt of the returned parcel, L&W undertakes to contact the Customer to offer either to resend the parcel or a refund. If the Customer chooses to have the parcel resent, they must pay the sum of 4.99€ to cover the reshipping costs.
Article 14: Delivery Problems Caused by the Carrier
Any anomaly concerning delivery (damage, product missing compared with the delivery note, damaged parcel, broken product, etc.) must imperatively be noted on the delivery note in the form of "handwritten reservations", accompanied by the Customer's signature. The consumer must at the same time confirm this anomaly by sending the carrier, within two working days following the date of delivery, a registered letter with acknowledgement of receipt setting out said claims. The consumer must send a copy of this letter by e-mail or by ordinary post to: L&W WUSAKI, Service Client, 245 Allée Louis Blériot, Résidence Mandelieu 2000 - 06210 MANDELIEU – France.
The company will thus be able to replace the damaged product or offer a refund and will be able to assert its rights against the carrier.
Article 15: Delivery Errors
- The consumer must submit to L&W, on the day of delivery or at the latest on the first working day following delivery, any claim of delivery error and/or of non-conformity of the products in kind or in quality compared with the information shown on the order form. Any claim made after this period will be rejected.
- This claim must be submitted to L&W preferably by e-mail to the e-mail address indicated on the delivery note or by logging in to the customer account on the site wusaki.com. For the request to be processed properly, the consumer must specify the order reference shown on the delivery note.
- Any claim not made in accordance with the rules defined above and within the time limits set cannot be taken into account and shall release L&W from all liability towards the Customer.
- Upon receipt of the claim, L&W will assign a goods return or exchange number for the product(s) concerned and will communicate it to the Customer by e-mail. The exchange or return of a product may only take place after an exchange number has been assigned in accordance with the procedure set out above.
- In the event of a delivery error or exchange, any product to be exchanged or refunded must be returned to L&W in its entirety and in its original packaging, to an address communicated by L&W.
To be accepted, any return request must first be reported to L&W's Customer Service.
Shipping costs are borne by L&W, except where it turns out that the product taken back does not correspond to the original declaration made by the Customer in the return form.
Article 16: Product Guarantee
In accordance with Article 4 of décret n°78-464 du 24 mars 1978 (French Decree No. 78-464 of 24 March 1978), the provisions herein cannot deprive the Customer of the legal guarantee which obliges the professional seller to guarantee them against all the consequences of hidden defects in the item sold. The consumer is expressly informed that L&W is not the producer of the products presented on the site wusaki.com, within the meaning of loi n°98-389 du 19 mai 1998 (French Law No. 98-389 of 19 May 1998) relating to liability for defective products.
For products of the "kitchen knives" type and only for these products (excluding knives contained in cutlery sets), this guarantee is extended to a total duration of 10 years (2 years of legal guarantee + 8-year extension).
Consequently, in the event of damage caused to a person or property by a defect in the product, the consumer may only seek the liability of the producer of that product, on the basis of the information shown on the packaging of said product.
However, it is important to remember that our guarantee does not cover problems relating to wear, misuse or improper maintenance of any of our products. Rusted knives or utensils are not covered by the guarantee, as rust is not considered a product defect, regardless of the duration of use (short or long). Rust results from too many environmental factors, or from inappropriate use or maintenance.
Article 17: Returns and Right of Withdrawal
Exercising the right of withdrawal within 60 days with Customer Service
The consumer has a period of 60 days, from the day following the day of delivery of the products, to exercise their right of withdrawal in respect of products that do not suit them. The products must be new, unused and in their intact packaging. This right of withdrawal must be exercised by e-mail or letter to L&W's Customer Service.
This period runs from the Customer's receipt of the order. If this period expires on a Saturday, a Sunday or a public holiday or non-working day, it is extended until the first following working day.
In order to speed up the refund process, it is advisable to follow the logistics return procedure for the product, that is to say, to obtain a return number from L&W's Customer Service.
This return number will give the consumer 7 additional days from the date on which the return number was obtained to return the products, at their own expense. The product must be returned to an address communicated by L&W.
Free returns from Metropolitan France
To be exempt from return costs, the following conditions must be met: the return request must be made within 60 days from the day following the day of delivery of the products; the parcel must be returned from Metropolitan France; the returned product must be new and unused, in its packaging in perfect condition.
The return request must be made by e-mail, letter or telephone. If the conditions are met, L&W's Customer Service will send the consumer by e-mail a Colissimo return label to be affixed to the parcel. The parcel must be dropped off at a post office within 7 days following receipt of the return label by e-mail.
Conditions for returnable products
Returned products must be new and unused, in their complete and intact original packaging (including accessories and documentation), and in perfect condition for resale. Any product that has been used, damaged, soiled, consumed (for consumables) or whose original packaging has been damaged in such a way as to compromise its resale cannot be subject to the right of withdrawal. Gift vouchers and items resulting from a personalised order (for example, a knife with custom engraving)will also not be taken back.
Where the product's packaging is damaged, the product cannot be put back on sale. L&W's Customer Service will then refund the product up to 75% of the total amount. Damaged or used products (e.g. broken tip) will not be refunded.
In the event of abusive returns, Wusaki reserves the right to refuse a subsequent order.
Exceptions to the right of withdrawal
The supply of goods whose price depends on fluctuations in financial market rates, the supply of goods made to the consumer's specifications or clearly personalised, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.
Refund and right of withdrawal
This right of withdrawal is exercised without penalty, with the exception of the initial shipping costs. Where the right of withdrawal is exercised, the Customer may choose to request either a refund of the sums paid (less the initial delivery costs) or an exchange of the product. In the case of an exchange, reshipment will be at the consumer's expense. The consumer must send back or hand over the goods to the company at the following address: SARL LW WUSAKI, 245 ALLEE LOUIS BLERIOT (RESIDENCE MANDELIEU 2000), ZI LES TOURRADES, 06210 MANDELIEU, without undue delay and, in any event, no later than 60 days after communicating their decision to withdraw to the company. This deadline is deemed to be met if the consumer sends back the goods before the expiry of the 60-day period.
Where the right of withdrawal is exercised, L&W will make every effort to refund the consumer within 14 days following the consumer's request.
However, given the technical nature of the products sold, this period may be extended to 30 days, in particular where the product requires a technical check (cf. products that must first be tested).
If the product arrives damaged at the Customer's premises, the consumer will then be refunded by re-crediting their bank account in the case of payment by bank card, or by cheque in other cases, or in the form of a credit note if the Customer so requests, including delivery costs (with the exception of any additional costs resulting from the fact that the consumer has chosen, where applicable, a method of delivery other than the least expensive standard delivery method offered by the company) without undue delay and, in any event, no later than fourteen days from the day on which the company is informed of the consumer's decision to withdraw. Wusaki will make the refund using the same method of payment as that used by the consumer for the initial transaction, unless the consumer expressly agrees to a different method; in any event, this refund will not incur any costs for the consumer.
However, the company may withhold the refund until it has received the goods or until the consumer has supplied proof of having sent back the goods, whichever is the earlier.
In the event of a partial refund of an order paid for in 3 instalments via Scalapay, the amount refunded will be deducted from the last payment instalment.
Article 18: Force Majeure
Neither party shall have failed to fulfil its contractual obligations insofar as their performance is delayed, hindered or prevented by a fortuitous event or force majeure. A fortuitous event or force majeure shall mean any irresistible facts or circumstances, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by them despite all reasonably possible efforts. The party affected by such circumstances shall notify the other within ten working days following the date on which it became aware of them. The two parties shall then meet, within one month, unless this is impossible due to the force majeure event, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the force majeure event lasts longer than three months, these general terms and conditions of sale may be terminated by the injured party. The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually recognised by the case law of the French courts and tribunals: blockage of means of transport or supply, earthquakes, fires, storms, floods, lightning, the shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers.
Article 19: Partial Invalidity
If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other provisions shall retain their full force and effect.
Article 20: Non-Waiver
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be interpreted for the future as a waiver of the obligation in question.
Article 21: Applicable Law
These general terms and conditions are governed by French law, notwithstanding any rule relating to conflicts of laws. This applies to substantive rules as well as to formal rules. In the event of disputes, the Customer may submit their complaints to L&W's Customer Service in order to seek an amicable solution.
Failing amicable agreement between the Parties, the dispute will be submitted to the French courts.
With the exception of natural persons, for whom the competent courts will be determined by the provisions of the Code de procédure civile (French Code of Civil Procedure), in the event of any dispute concerning the interpretation, performance or termination hereof, the Tribunal de Commerce de Grasse (Commercial Court of Grasse) shall have sole jurisdiction, notwithstanding any rule relating to conflicts of laws. This attribution of jurisdiction shall also apply in the event of multiple defendants or third-party claims under a guarantee.
Article 22: Data Protection (Informatique et Libertés)
The information requested from the Customer is necessary for processing their order and may be communicated to L&W's contractual partners involved in the performance of that order. The Customer may write to L&W WUSAKI - Service Marketing, 245 Allée Louis Blériot, Résidence Mandelieu 2000 - 06210 MANDELIEU - France, to object to such communication, or to exercise their rights of access and rectification in respect of the information concerning them held in L&W's files, under the conditions provided for by the law of 6 January 1978.
Article 23: Consumer Mediation Service
In accordance with the provisions of articles L611-1 to L641-1 and R612-1 to R616-2 of the Code de la consommation relating to the amicable settlement of disputes between professionals and consumers, in the event of an unresolved dispute between Wusaki.com and the Consumer, the latter may refer the matter, free of charge, to the consumer mediator to which Wusaki.com is subject.
Before referring any matter to the mediator, the consumer must first have attempted to resolve the dispute directly with Wusaki.com, by means of a written complaint sent to Customer Service, or in accordance with the procedures laid down in the General Terms and Conditions of Sale.
Consumer mediation is a form of out-of-court dispute resolution. Where the admissibility conditions are met, the mediation takes place according to a specific process, in accordance with the texts in force. This procedure is free of charge for the consumer (article R612-1 of the Code de la consommation).

Article 24: Changes to and Updating of the Catalogue
The written information and descriptions, as well as the accompanying photos on the product pages, may be modified without reservation or notice.
When collections and catalogues are updated, only the written descriptions are contractual; the photos are said to be "Non-contractual". For further information on the products, the Customer should, if they so wish, request confirmation of the accuracy of the online image before starting an ordering procedure.
Article 25: Personal Data
In the course of your use of Wusaki.com, we collect and process some of your personal data. By using our site, and by registering on our site, you acknowledge and accept the processing of your personal data by Wusaki.com in accordance with the applicable law and the provisions of our Privacy Policy.
