The purpose of this Privacy Policy is to describe how Wusaki.com (hereinafter referred to as "Wusaki", "we" or "the Site") collects, uses and shares information about you through our online interfaces. Please read this Privacy Policy carefully to understand what we do. If you do not understand any aspect of our Privacy Policy, please do not hesitate to contact us at info@wusaki.com. Your use of our Site is also governed by our General Terms and Conditions of Sale.

Wusaki.com is a website operated by the company SARL L&W, whose registered office is located at 245 Allée Louis Blériot 06210 Mandelieu. If you reside or are located in the European Economic Area ("EEA"), Wusaki.com is the data controller of all Personal Data (as defined below) collected via the Site and of certain Personal Data collected from third parties, in accordance with this Privacy Policy.

Information covered by this Privacy Policy

This Privacy Policy covers the information we collect from you through our Site. Some of the features of our Site may be used without disclosing any Personal Data, although Personal Data is required in order to benefit from certain features or services relating to the Online Courses. In order to access certain features and benefits of our Site, you may need to submit, or we may collect, "Personal Data" (that is, data that can be used to identify you). Personal Data may include, in particular, information such as your name and email address. You are responsible for ensuring the accuracy of the Personal Data you submit to Wusaki. Inaccurate information may limit your ability to use the Site, and affect the information you receive when using the Site as well as our ability to communicate with you. What you consent to by using our Site

Please understand that, by submitting any Personal Data to us, you accept and consent to our collecting, using and disclosing your Personal Data in accordance with this Privacy Policy and our General Terms and Conditions of Sale as permitted or required by law. If you do not agree with these terms, please do not provide us with any Personal Data. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personal Data, we may not be able to provide you with the services that may be offered on our Site. Consent may be withdrawn at any time by sending your request to info@wusaki.com. Please note that we may also rely on legitimate interests or on the performance of a contract to continue processing your data.

The information we collect

We collect two types of information about the users of our site:

Information about your use of our site. When you use our site, we may track, collect and aggregate information indicating, among other things, which pages of our Site were visited, the order in which they were visited, when they were visited, and which hyperlinks you clicked. We also collect information from the URLs you used to access our Site. The collection of such information may involve logging the IP address, operating system and browser used by each user of the Site. We also use (or may use) cookies when you visit our Site. The use of "consentmanager" involves the processing of personal data originating from the terminal devices used, such as the IP address.

The legal basis for the processing is Art. 6 Para. 1 S. 1 lit. c) in conjunction with Art. 6 Para. 3 sentence 1 lit. a) in conjunction with Art. 7 Para. 1 GDPR and, in the alternative, lit. F). Its purpose is to help the customers of "consentmanager" (controllers within the meaning of the GDPR) to fulfil their legal obligations (for example, the obligation to provide proof of consent). The legitimate interest of "consentmanager" is to retain the user's preferences regarding the use of cookies and other functionalities. "Consentmanager" stores your data for as long as your user settings are active. Two years after you have made your settings, your consent will be requested again and your settings will be recorded again.

Personal Data provided directly by you or by third parties. We collect the Personal Data you provide to us when you create an account, update or change your account information, purchase products or services, respond to a questionnaire, sign up for email updates, and send us emails. We may use the Personal Data you provide to us to answer your questions, provide you with a service, send you your orders, and send you emails about the maintenance or updates of the Site.

Account creation: If you create an account on our Site, you must provide us, where applicable, with Personal Data such as your name and email address.

Updates: Wusaki may offer you the option of receiving updates by email or by means of posts on certain parts of the Site accessible only to registered users. To subscribe to these services, you must provide us, where applicable, with Personal Data such as your name and email address.

Communications with Wusaki: We may receive Personal Data when you send us an email or contact us in any other way.

Third-party sites: We may receive Personal Data when you access or log in to a third-party site, e.g. Facebook, from our Sites. This may include the text and/or images of your Personal Data available from the third-party site.

Questionnaires: We may receive Personal Data when you provide it by responding to one of our questionnaires. It may include details  of your education and employment.

Third-party bank card processing : Wusaki allows you to pay for products and other services by bank card through a third-party payment processing service provider. Please note that our service provider, and not Wusaki, collects and processes your bank card information.

How we use information

Information relating to your use of our Site. We use information relating to your use of our Site to develop better and more useful services, by carrying out statistical analyses of the collective characteristics and behaviour of our users, and by measuring demographics and the interest shown in specific parts of our Site. We may also use this information to ensure the security of our services and of the Site.

Personal Data provided directly by you or by third parties: Subject to the provisions of this Privacy Policy or of a specific agreement with you, Wusaki undertakes not to disclose your Personal Data. In addition to the other uses set out in this Privacy Policy, we may disclose and otherwise use Personal Data as described below.

Providing the Site and our services: We use the Personal Data you provide to us in order to enable you to access and use the Site and to provide you with any product, information or service you have requested from us.

Updates: We use the Personal Data collected when you sign up for our various email or update services to send you messages relating to the Site. We may also archive this data and/or use it for subsequent communications with you where we are legally permitted to do so.

Communications with Wusaki: When you send us an email or contact us in any other way, we may use the data you have provided to respond to your communication and/or as described in this Privacy Policy. We may also archive this data and/or use it for subsequent communications with you where we are legally permitted to do so.

Disclosure to processors for the operation and maintenance of Wusaki: We use various service providers and processors (hereinafter referred to collectively as the "Processors") to help us provide you with our products and services. Our Processors may have limited access to your Personal Data in the course of providing products and services to Wusaki, so that we may in turn provide you with our products and services. Processors may include contractors and suppliers that provide us with technology, services and/or content relating to the operation and maintenance of the Site. Access to your Personal Data by Processors is limited to the information reasonably necessary for the Processor to perform its limited function for us.

Government authorities, legal rights and remedies: Wusaki may share your Personal Data with various government authorities in response to subpoenas, court orders or other legal proceedings; to establish or exercise our legal rights or to protect our property; to defend ourselves against legal claims; or under other requirements provided for by law. In such cases, we reserve the right to raise or waive any objection or legal right available to us. We may also share your Personal Data where we consider it appropriate in order to investigate, prevent or take legal action in relation to illegal or suspected illegal activities; to protect and defend the rights, property or safety of Wusaki, the Site, our users, customers or others; and in connection with our General Terms and Conditions of Sale and other agreements.

Disclosure to an acquirer: Wusaki may disclose and/or transfer your Personal Data to an acquirer, assignee or other successor in the context of a sale, merger or complete or near-complete reorganisation of the capital, businesses or assets of Wusaki relating to your Personal Data.

Physical storage of your data

The personal data you send us is physically located in France, in a secure data centre located at the following address: Datacenter OVH SGB-2 67000 Strasbourg.

The following are the measures we have implemented for the security of your data on our storage platform:

Data storage security:

  •          Encryption: AES CBC ESSIV algorithm
  •          Key: SHA with a length of 256 bits or more
  •          passphrase: random length of between 256 and 512 characters made up of numbers, letters and symbols, entered interactively each time the backup nodes are started in order to ensure that physical theft of the server renders the data inaccessible

 Data transfer security:

  •          Encryption: SSH AES CBC
  •          Key: RSA with a length of 2048 bits or more
  •          passphrase: random length of between 12 and 32 characters made up of numbers, letters and symbols

Retention of Personal Data

We keep your Personal Data for as long as necessary in order to process your request. In the absence of any activity on your part on our site, we delete all of your account data after 5 years.

Confidentiality and security of Personal Data

We consider the confidentiality and security of your personal data to be of the utmost importance. We undertake to use physical, technical and administrative security measures in line with the standards of our industry to preserve the confidentiality and security of your Personal Data, and we will not disclose it to third parties, except as otherwise provided in this Privacy Policy or where we believe in good faith that such disclosure is necessary in particular cases, for example in the event of a physical threat to you or to others, in accordance with applicable law. Only the company's internal departments directly involved in the management of your order and your products have access to your data. As the Internet is not a 100 % secure environment, we cannot guarantee the security of Personal Data, and there is a risk that an unauthorised third party may succeed in circumventing our security systems or that the transmission of your data over the Internet may be intercepted. You are responsible for protecting the security of your login details. Please note that emails and other communications you send to us through our Site are not encrypted.

 

Updating or deleting your Personal Data

You have certain rights with regard to your Personal Data. You may access your Personal Data and confirm that it remains accurate and up to date, or choose whether you wish to receive messages from us, by logging in to the Site and visiting your user account page. You may also delete your account on our site at any time from your user account page.

If you would like further information about your rights or wish to exercise any of them, you may also contact us at info@wusaki.com. You have the right to ask us to:

  •          provide access to any Personal Data we hold about you (right of access);
  •          prevent the processing of your Personal Data for direct marketing purposes;
  •          update any Personal Data that is out of date or inaccurate;
  •          delete any Personal Data we hold about you;
  •          restrict the way in which we process your Personal Data;
  •          provide your Personal Data to a third-party service provider; or
  •          provide you with a copy of any Personal Data we hold about you.

We try to respond to every email promptly where possible, and to provide our response within the time limits set by applicable law. Please bear in mind, however, that there will be residual information that will remain in our databases, access logs and other records, which may or may not contain your personal data. Please also note that certain Personal Data may be exempt from these requests in certain circumstances, such as where we must continue to process Personal Data in order to comply with a legal obligation.

When you send us a request by email, we may ask you to provide us with the information necessary to verify your identity.

If you reside or are located within the EEA, you may also lodge a complaint with our supervisory authority for data protection matters (namely the office of the information commissioner in France) or seek a remedy before the local courts if you believe that your rights have been infringed.

 

Changes to our Privacy Policy

Please note that we review our privacy practices from time to time and that these practices are subject to change. Any change or update takes effect immediately upon publication on our Site. We will inform you of any material change to this Privacy Policy by posting a notice on the home page of our Site for a reasonable period after such change and by amending the effective date (located at the bottom of this page). Please return to this page periodically in order to remain familiar with the most recent version of this Privacy Policy.

 

No information from children under 13

Protecting children's privacy is very important to Wusaki. Consequently, we do not knowingly collect or manage on our Site Personal Data from persons under the age of 13, and no part of our Site is directed at persons under the age of 13. If you are under 13, please do not use or access this Site at any time or in any way. We undertake to take appropriate measures to delete Personal Data of persons under the age of 13 that has been collected on our Site without verified parental consent, as soon as such Personal Data is detected.
